TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IN ANY 12-MONTH PERIOD IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE DURING THAT PERIOD.
Some U.S. states do not allow the exclusion or limitation of certain damages, so the above limitations may not fully apply to you.
You agree to indemnify, defend, and hold harmless Family Scam Shield and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
Any dispute arising out of or relating to the Service or these Terms will first be addressed through informal good-faith discussions. To initiate this process, email info@familyscamshield.com with a written description of the dispute. If the dispute is not resolved within 30 days, it shall be submitted to binding individual arbitration under the rules of the American Arbitration Association (AAA).
You and Family Scam Shield each waive the right to a jury trial and the right to participate in any class action lawsuit or class-wide arbitration.
You have 30 days from first accepting these Terms to opt out of the arbitration clause by emailing info@familyscamshield.com with the subject line “Arbitration Opt-Out.” Opting out does not affect any other part of these Terms.
Family Scam Shield may update or modify the Service, including adding or removing features, at any time. These Terms may also be updated. For material changes, we will update the “last updated” date at the top of this page and notify you by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
