These Terms and Conditions (“Terms”) govern your access to and use of the Family Scam Shield website, emails, SMS alerts, and any related services (collectively, the “Service”). By subscribing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who we serve
The Service is intended for residents of the United States who are at least 18 years old and able to form a binding contract. By using the Service, you represent that you meet these requirements and are using it for personal or family use, not resale.
2. Subscriptions, billing, and renewal
- Family Scam Shield is offered as a recurring subscription with different plans (including optional free‑trial plans) as described on the pricing page.
- By starting a subscription, you authorize recurring charges to your chosen payment method until you cancel.
- Prices, plans, and features may change in the future; changes will apply to new billing periods, and you will be notified in advance where required by law.
Refunds, trials, and cancellation rights are explained in the Refund Policy, which forms part of these Terms.
3. Use of the Service
Family Scam Shield provides educational scam‑awareness content, example scripts, and alerts for information purposes only. The Service does not provide financial, legal, or investment advice and does not guarantee that you or your parents will never experience fraud or financial loss.
You agree that:
- You will not use the Service for any illegal purpose, to harass others, or to send spam.
- You will not attempt to copy, resell, reverse‑engineer, or interfere with the operation of the Service.
- You are responsible for how you share content with your parents and relatives (for example, forwarding emails or SMS messages).
Family Scam Shield may suspend or terminate access if these rules are violated or the Service is abused.
4. Accounts and security
You are responsible for keeping your account information (including email and any login details) accurate and secure, and for all activity that occurs under your account. Notify Family Scam Shield promptly if you suspect unauthorized use.
5. Privacy and cookies
Your use of the Service is also governed by the Privacy Policy and Cookies & Tracking section, which describe how personal information and cookies are used, including rights for California residents under the CCPA/CPRA. By using the Service, you consent to these practices.
6. Intellectual property
All text, graphics, logos, and other content in the Service are owned by Family Scam Shield or its licensors and are protected by US copyright and trademark laws. You receive a limited, non‑exclusive, non‑transferable license to access and use the content solely for your personal, non‑commercial family use. You may not remove copyright notices or use the content in competing products or services.
7. Third‑party services
The Service may include links to or integrations with third‑party websites, email providers, or messaging platforms (such as Gmail, SMS carriers, or messaging apps). Family Scam Shield is not responsible for those services, their content, or their privacy practices. Your use of third‑party services is governed by their own terms.
8. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, non‑infringement, or reliability of alerts or information.
Family Scam Shield does not promise that:
- the Service will detect or describe every scam;
- the content will always be error‑free or uninterrupted; or
- following guidance will prevent all losses.
9. Limitation of liability
To the maximum extent permitted by US law, Family Scam Shield and its owners, employees, and partners will not be liable for:
- any indirect, incidental, special, consequential, or punitive damages; or
- any loss of money, data, or goodwill arising from or related to your use of the Service,
even if advised of the possibility of such damages.
To the extent any liability cannot be excluded, total liability for all claims in any 12‑month period is limited to the amount you paid for the Service in that period. Some states do not allow certain limitations, so these may not apply to you.
10. Indemnification
You agree to indemnify and hold Family Scam Shield harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, violation of these Terms, or infringement of any third‑party rights.
11. Changes to the Service or Terms
Family Scam Shield may update or modify the Service, including adding or removing features, at any time. These Terms may also be updated from time to time. When material changes are made, the “last updated” date will change, and reasonable efforts will be made to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
12. Governing law and dispute resolution
These Terms are governed by the laws of the United States and the State of [insert state, for example Delaware or California], without regard to conflict‑of‑law rules.
Any dispute arising out of or relating to the Service or these Terms will first be addressed through informal good‑faith discussions. If not resolved, disputes will be brought exclusively in the state or federal courts located in [chosen state and county], and you consent to their jurisdiction and venue. You and Family Scam Shield waive the right to a jury trial to the extent permitted by law.
